الطفل المعاصر بين تطلعات المستقبل وغياب الآلية التفعيلية للحماية القانونية له

Abstract

تعتبر اتفاقية حقوق الطفل هي الضمان القانوني الأول الذي يلزم الدول الأطراف من ناحية قانونية بدمج السلسة الكاملة لحقوق الإنسان، بما فيها الحقوق المدنية والثقافية والاجتماعية خاصة للأطفال ما دون سن الثامنة عشر؛ ففي عام 1989، أقر قادة دول العالم بحاجة الأطفالإلى اتفاقية خاصة بهم ترعاهم وتكفل لهم حماية لكيانهم الإنساني. إن هذه الاتفاقية تتضمن 54 مادة وبروتوكوليين اختياريان، والاتفاقية تشرح بالتفصيل مضمون الحماية القانونية التي يجب على القانون أن يكفلها للطفل. لكن الإشكال المطروحهو: إلى أي مدى طبقت اتفاقية حقوق الطفل من طرف الدول المصادقة عليها؟وهل فعلا حظي الطفل في العالم المعاصر اليوم بالحماية القانونية بتلك المصداقية المنصوص عليها في مواد الاتفاقية، خاصة وأن المجتمع الدولي يشهد تغيراتوتحولات في المسار السياسي عقب ثورات الربيع العربي؟.

The Convention on the Rights of the Child is the first legal guarantee that legally obligates States to integrate all human rights, including civil, cultural and social rights, especially for children under the age of 18years. In 1989, world leaders recognized the need for children to have their own convention, which ensures the protection of their human entity. The Convention contains 54 articles and two optional protocols. The Convention specifies the content of the legal protection that the law must guarantee to the child. However, the question is: what extent has the Convention on the Rights of the Child been applied by the States that have ratified it?And the child in the modern world has he really benefited from the legal protection with the credibility stipulated in the articles of the Convention, especially as the international community witnessed changes in the political orientation following the revolutions of the Arab Spring ?.

La Convention relative aux droits de l'enfant est la première garantie légale qui oblige juridiquement les États à intégrer l'ensemble des droits de l'homme, y compris les droits civils, culturels et sociaux, en particulier pour les enfants de moins de 18 ans. En 1989, les dirigeants mondiaux ont reconnu la nécessité pour les enfants de posséder leur propre convention, qui assure la protection de leur entité humaine. La Convention contient 54 articles et deux protocoles facultatifs. La Convention précise le contenu de la protection juridique que la loi doit garantir à l'enfant. Cependant, la question qui se pose est la suivante : dans quelle mesure la Convention relative aux droits de l'enfant a-t-elle été appliquée par les États qui l'ont ratifiée ? et l'enfant dans le monde moderne va-t-ilréellement bénéficié de la protection juridique avec la crédibilité stipulée dans les articles de la Convention, surtout que la communauté internationale assiste à des changements dans l'orientation politique suite aux révolutions du Printemps arabe ?
